School discipline, suspensions and expulsion hearings

A discipline notice can arrive with only days to respond. I help families understand the charge, prepare for the hearing, and protect what goes in the record.

  • Reading the notice

I explain what the school says happened, which rule it relies on, and what it can and can’t do next.

  • Preparing for the hearing

We gather statements, records and anything that shows the fuller picture, and practice the questions you’re likely to hear.

  • When disability is part of the story

If your child has an IEP or 504 plan, or should have one, the school has extra steps to take before a long removal. I make sure it takes them.

  • Getting back to class

After a decision, I help with the return: a re-entry meeting, a behavior plan if one helps, and what the record should and shouldn’t say.

The days right after the notice matter most

Deadlines to respond are short and differ by state, so call as soon as the letter arrives.

Write down your child’s account while it’s fresh, keep every message from the school, and don’t sign anything you don’t understand. Then call me. We’ll go through the notice together and decide what to say, and what not to say, before the hearing.

Keep these together

  • The discipline notice and any letters

  • Your child’s own account, in their words

  • Names of anyone who saw what happened

  • The IEP or 504 plan, if there is one

Discipline questions

Can my child be suspended without a hearing?

Short suspensions usually come with an informal chance to respond. Longer suspensions and expulsions usually come with a formal hearing. The exact lines are set by state law and district policy.

Should my child speak at the hearing?

Sometimes. It depends on their age, what happened, and whether there’s a police matter as well. We decide together after reading the notice.

What if the school says behavior is the reason they can’t follow the IEP?

Behavior linked to a disability is usually something the plan should address, not a reason to drop it. We can ask for a review meeting and a behavior plan.
